Online Consignment Auction Terms & Conditions
By registering for and participating in this auction, all bidders agree to the following terms and conditions:
1. Auction Format
This is an online consignment auction conducted by Elite Auction Company. By placing a bid, you are entering into a binding agreement to purchase the item if you are the winning bidder.
2. Auction Closing
This auction will begin closing on Thursday, July 30 at 6:00 PM. Items may close in a staggered format. Be sure to monitor the auction closely as closing time approaches.
3. Buyer’s Premium
A 10% buyer’s premium will be added to the final bid price of each item and included in the total purchase amount.
4. Payment Terms
Payment is due in full at the conclusion of the auction. Accepted payment methods may include cash, approved check, or credit/debit card unless otherwise announced.
A 3% processing fee will be added to all credit/debit card payments.
5. Pickup Dates & Times
All items must be picked up during the scheduled pickup times:
Friday, July 31 from 9:00 AM to 6:00 PM
Saturday, August 1 from 8:00 AM to 2:00 PM
It is the buyer’s responsibility to remove all purchased items during the designated pickup window. Please bring any necessary help, tools, trailers, straps, or equipment needed to load and haul your items.
6. Removal of Items
All items must be removed by the end of the final pickup day unless prior arrangements have been made and approved by Elite Auction Company. Any items not removed during the stated pickup times may be considered abandoned, and no refund will be issued.
7. Condition of Items / No Warranties
All items are sold AS IS, WHERE IS, with no warranties or guarantees of any kind, expressed or implied.
Elite Auction Company makes no representations regarding the condition, age, authenticity, functionality, merchantability, fitness for a particular purpose, or completeness of any item. Bidders are responsible for inspecting items and determining the condition and suitability of each item before bidding.
8. No Returns / No Refunds
All sales are final. No refunds, returns, exchanges, chargebacks, or adjustments will be allowed for any reason.
9. Bidder Responsibility
Bidders are responsible for all bids placed under their account. Be sure to review your bids carefully before submitting them. Mistakes, forgotten bids, or accidental bids will not be grounds for cancellation.
10. Auctioneer’s Authority
Elite Auction Company reserves the right to:
add or remove items from the auction
refuse service or bidding privileges to any person
resolve bidding disputes as it sees fit
cancel or reopen bidding in the event of technical issues, clerical errors, or disputes
update terms, item descriptions, or sale information as needed
11. Default / Failure to Pay
If a winning bidder fails to pay for or pick up purchased items within the stated terms, Elite Auction Company reserves the right to revoke bidding privileges, resell the item, and hold the bidder responsible for any resulting loss or fees.
12. Liability
Persons attending pickup or inspection do so at their own risk. Buyers assume full responsibility for any damage, injury, or loss resulting from the purchase, removal, loading, or use of any item. Elite Auction Company, the seller, and the property owner shall not be liable for accidents, injuries, or losses.
13. Acceptance of Terms
By bidding in this auction, you acknowledge that you have read, understood, and agreed to all terms and conditions stated above.
